1. About these terms
These terms govern your use of halobenefits.co.uk and the Halo platform (app.halobenefits.co.uk), operated by Halo Benefits Ltd ("Halo", "we", "us"). By accessing or using our services, you agree to be bound by these terms.
2. Our services
Halo provides a platform that enables employers, employees, and nurseries to set up and manage childcare arrangements under the workplace nursery exemption (Section 318 ITEPA 2003). Our services include:
- Arrangement creation and management between employers, employees, and nurseries.
- Salary sacrifice calculation and administration.
- Compliance governance and documentation.
- Payment facilitation between employers and nurseries.
Halo is operational infrastructure. We do not provide tax advice, legal advice, or financial advice. You should consult your own professional advisers where appropriate.
3. Accounts
To use the Halo platform, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when registering and keep your details up to date.
4. Employer responsibilities
Employers using Halo agree to:
- Implement Halo Pay (salary sacrifice) arrangements in accordance with employment law.
- Make nursery fee payments directly to nurseries as agreed.
- Ensure arrangements comply with the workplace nursery exemption requirements.
- Provide accurate company and employee information.
- Review and approve arrangements submitted by their employees.
5. Employee responsibilities
Employees using Halo agree to:
- Provide accurate personal, child, and nursery information.
- Notify their employer and Halo of any changes to their arrangements.
- Understand that Halo Pay (salary sacrifice) reduces gross salary, which may affect other salary-linked benefits.
- Accept the terms of any Halo Pay agreements presented through the platform.
6. Nursery responsibilities
Nurseries using Halo agree to:
- Maintain valid Ofsted or Care Inspectorate registration.
- Provide accurate fee and child attendance information.
- Verify child enrolment details when requested.
- Notify Halo of any changes to fees, registration status, or child attendance.
7. Fees and payment
Halo's service fees are set out in the agreements between Halo and each party. Employers pay nursery fees directly — Halo does not handle or hold childcare payments. Payment processing for Halo service fees is handled via GoCardless Direct Debit.
8. Savings estimates
Any savings calculations or estimates provided through the Halo platform or website are indicative only. Actual savings depend on individual circumstances including income, tax code, and other deductions. These figures do not constitute tax advice. See our assumptions and methodology page for details.
9. Intellectual property
All content, designs, code, and branding on the Halo platform and website are owned by Halo Benefits Ltd or its licensors. You may not copy, modify, distribute, or create derivative works without our written permission.
10. Limitation of liability
To the fullest extent permitted by law, Halo's liability is limited to the fees paid by you to Halo in the 12 months preceding any claim. We are not liable for any indirect, consequential, or incidental damages, including lost savings, lost profits, or tax liabilities arising from the use of our services.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Termination
Either party may terminate their use of Halo services by providing written notice. Active arrangements will be managed through to their agreed end date or cancelled in accordance with the relevant arrangement terms. We reserve the right to suspend or terminate accounts that breach these terms.
12. Changes to these terms
We may update these terms from time to time. We will notify you of material changes via email or through the platform. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
